Kenimer, accused of taking his seven-year-old daughter, Betty Ann, out of the jurisdiction of the court pending settlement of a contest over her custody.

Prior to adjournment of the hearing yesterday, Atty. Hal Lindsay, who, with Attys. Roy Harris and Tom Camp, represent Kenirequested Judge Pharr to strike out all but one of the 238 counts of contempt. Each count represents a day Kenimer was absent from the court's jurisdiction with his daughter. The judge also took his motion under advisem*nt.

Atty. Harris argued that even if Kenimer had not purged himself of contempt by voluntarily returning with the child, there were mitigating circ*mstances. He cited Kenimer's love for his little daughter. Sol. Gen.

Paul Webb, who drew up the contempt charges, declared Kenimer guilty of a flagrant violation of the court's order. W. R. Smith Dies at Home William R. Smith, 77, died of a heart attack early yesterday at his residence, 116 Elizabeth N.
